    Job Title: Prosecutions Associate * 2
    Team: Prosecutions & Monitoring

    Job Status: 1 Permanent, 1 Temporary (12 months) Existing position vacancies
    Reports to: Manager, Prosecutions & Monitoring
    Job Level: 7

    I. JOB PURPOSE

    Oversees day-to-day activities of the prosecutions process and manages proceedings before the Discipline and Fitness to Practise Committees, including collaborating with system partners and ensuring legislative timelines are met.

    II. KEY RESPONSIBILITIES

    Plans, recruits, trains and supervises work activities to achieve team goals related to the prosecution and/or resolution of allegations of misconduct, incompetence and/or incapacity: assigns and delegates work, provides feedback and coaching to enhance employee contributions, participates in recruitment and orientation activities, provides input and recommendations for performance assessments, and works with manager to identify performance expectations and goals.

    Oversees and manages the prosecution of matters before the Discipline and Fitness to Practise Committees and unregistered practitioners by coordinating and monitoring processes; instructing external CNO legal counsel; identifying and resolving procedural, regulatory and statutory issues that arise; negotiating with self-represented members.

    Explains regulatory processes to relevant parties and system partners related to the prosecutions function, and shares expertise and regulatory knowledge with internal CNO teams.

    Drafts, prepares, and reviews legal documents.

    Oversees recruitment and management of expert witnesses.

    Works in collaboration with other CNO teams to implement process improvements ensuring consistency and legislative compliance.

    III. REQUIRED QUALIFICATIONS

    Education and Experience

    LL.B. or JD.
    Practicing Lawyer in good standing with Law Society of Ontario, with 3 or more years of relevant experience.
    Experience providing direction and supervision to staff.

    Job Competencies, Knowledge, Skills

    Analytical & Critical Thinking – Uses solid knowledge and understanding of relevant legislation and its application, such as the Regulated Health Professions Act, 1991, Nursing Act, 1991, administrative law and other legal principles (e.g., procedural fairness and confidentiality), CNO By-Laws and Practice Standards, to support the prosecution and/or resolution of matters before the Discipline and Fitness to Practise Committees. Uses analytical techniques to evaluate complex information and reach a conclusion in continuously evolving situations.

    Communication – Uses effective communication skills to prepare complex legal documents in a clear and concise manner and convey complex legal and process information in plain language to foster understanding. Adjusts communication delivery when difficulty in understanding arises.

    Consulting & Advising – Consults and discusses complex legal and regulatory issues with external CNO legal counsel, and shares expertise with internal CNO teams. Initiates and participates in development of process improvements and collaborates with internal CNO teams and external CNO legal counsel to ensure legislative compliance.

    Proficient in Microsoft Office such as Word, PowerPoint, Excel and Outlook and collaborative technologies such as Teams, Zoom and SharePoint.

    Hiring Range:

    $124,942.00 - $132,770.00

    Full Salary Range:

    $124,942.00 - $149,930.00
